At Omnisend, we value your privacy and are committed to protecting your personal data. This notice explains how we collect, use, share, and retain your personal information when you:
- Apply for a specific position with us through any channel
- Submit a general application and join our talent pool through our general application option
- Are contacted by us or express interest in employment opportunities with Omnisend
- Subscribe to our “Working at Omnisend” newsletter
- Are referred to us by current employees, recruitment agencies, or other third parties
- Attend recruitment events, career fairs, or networking sessions hosted or attended by Omnisend
- Communicate with our recruiters or hiring teams through any platform (collectively, “Candidate(s)” or “you”)
The Omnisend entity responsible for your personal data depends on the role and location you’re applying for. For European positions, Omnisend UAB (Lithuania) acts as the data controller under GDPR. For US positions, Omnisend Inc. acts as the data controller under applicable US privacy laws. Regardless of which entity serves as controller, we apply consistent privacy standards across all Omnisend operations and comply with all applicable data protection laws in each jurisdiction.
What personal data we collect
For Job Applications and Talent Pool
We may collect the following types of personal data, depending on how you apply:
- Identifying information: full name, email address, phone number, location
- Application materials: CV, cover letter, education, employment history, skills, certifications, references or recommendations
- Communications: messages and calls exchanged with recruiters (via LinkedIn, email, phone, etc.)
- Interview recordings/transcripts (only with your prior consent)
- Public profile data (e.g., LinkedIn) when you apply or are sourced via public job boards
- Other data, such as recruiters’ comments and/or interview notes made within our applicant tracking system
We do not intentionally collect sensitive personal data such as race, ethnicity, political opinions, health information, or religious beliefs. Please refrain from including such information in your application materials unless legally required.
For Career Newsletter Subscription
For newsletter subscribers, we collect:
- Contact information: email address, name
- Engagement data: email open rates, click-through rates, unsubscribe status
How we collect your data
We collect your personal data through several channels, depending on how you engage with our recruitment process. This includes instances when:
- You apply directly via our Careers page, whether to a specific open position or through our general talent pool application
- You apply through LinkedIn, or via other job boards where our vacancies are posted
- Our recruiters reach out to you proactively based on publicly available information, such as your LinkedIn profile or data provided by third-party sourcing tools
- You attend or register for recruitment events, career fairs, tech meetups, or networking sessions where Omnisend representatives are present
We may also collect your data when you communicate with us via email or other direct messaging platforms, or when you are referred to us by a colleague or contact. Additionally, we may receive your data through recruitment service providers or agencies.
Newsletter data is collected when you subscribe directly through our Careers page, opt-in during a job application or talent pool registration, subscribe at recruitment events, or opt-in through career-related communications. All newsletter data is processed exclusively within our own Omnisend email marketing platform, which we use to manage and send our career newsletters, ensuring your data remains within our secure ecosystem.
For job applications and talent pool participants, regardless of the initial point of contact, all candidate data is ultimately stored and managed within our applicant tracking system (ATS), Lever, which serves as our central recruitment platform.
Purposes of Processing
Recruitment and Talent Pool
We process your personal data to assess your suitability for current and potential future job opportunities and to manage all aspects of the recruitment process, including communication throughout selection stages. With your consent, we maintain a talent pool of potential candidates for future roles, matching your skills and preferences with suitable opportunities while continuously improving and streamlining our recruitment practices. Our processing is based on steps necessary to enter into a potential employment contract (Article 6(1)(b) GDPR) and our legitimate interest in effective recruitment and talent identification (Article 6(1)(f) GDPR).
When you join our talent pool through our general application or consent to future consideration, your profile remains active for 24 months from your last interaction. During this time, we may proactively reach out when suitable roles become available. You can update your preferences or withdraw consent at any time. The legal basis for these processing activities is your explicit consent (Article 6(1)(a) GDPR).
“Working at Omnisend” Newsletter
Our career newsletter keeps you informed about Omnisend opportunities and company culture. We send updates about new job openings, life at Omnisend, recruitment events, career development tips, and company news. We track engagement metrics to improve the relevance and quality of our content. This processing is based on your explicit consent (Article 6(1)(a) GDPR).
The newsletter is included in your combined consent for talent pool and career communications. However, you maintain separate control over each communication type – you may unsubscribe from newsletters while remaining in our talent pool for direct opportunity contacts, or adjust your preferences for either at any time.
Data sharing and service providers
Access to your personal data is restricted to internal recruiters, HR personnel, and relevant hiring managers involved in the recruitment process, on a need-to-know basis.
We also share data with authorized third-party service providers, including but not limited to Lever (applicant tracking system), Metaview (interview transcription), Google Workspace, Slack and LinkedIn (communication platforms), and other tools that support our recruitment operations.
When specifically required by law, data may also be shared with public authorities or regulators.
Use of AI tools
We may use AI-powered tools to support and enhance our recruitment process. Specifically, with your explicit and informed consent, your online interviews may be recorded and transcribed using AI-based tools (e.g., Metaview) for the purpose of improving interview quality, note-taking accuracy, and overall candidate evaluation. You are under no obligation to consent, and your decision will not affect the outcome of your application.
We do not rely on automated decision-making, including profiling, as defined under Article 22 of the GDPR. All hiring decisions are made by human reviewers based on a thorough assessment of your candidacy.
Data retention
Recruitment and Talent Pool
When you apply to our talent pool, we retain your data for two years from your last interaction to consider you for future roles. For applications to specific positions without talent pool consent, data is kept only for the active recruitment process and up to three months after process completion, then securely deleted. If you are offered and accept a position at Omnisend, the personal data collected during recruitment will become part of your employee file and will be processed in accordance with applicable employment laws and our internal HR policies.
Career Newsletter
For active subscriptions, data is retained while you remain subscribed. After unsubscription, contact data is deleted within 30 days, with anonymized engagement data retained for up to 12 months for analytics purposes.
Your rights as a data subject
Under GDPR, you have the following rights:
- Access – Get a copy of your data and learn how we use it
- Rectification – Fix any wrong or incomplete information about you
- Erasure (Right to be Forgotten) – Ask us to delete your data
- Restriction – Ask us to limit how we use your data
- Objection – Tell us to stop using your data for certain reasons (e.g. automated decision-making and profiling)
- Data Portability – Get your data in a format you can use elsewhere
- Withdraw Consent – Change your mind about permissions you’ve given us
For talent pool and newsletter: You can change your preferences or remove yourself anytime.
